Service Terms and Conditions

RESERVATIONS

Full payment is required when booking an activity.In the event of a payment discrepancy this must be resolved within 24 hour of the activity.If payment and proof thereof is not received, the booking will be cancelled.
Amendments to booking is require via email to dive@prodive.co.za or fax 041 581 1144 at least 24 hours before
the activity date.
Amendments to the booking may be approved subject to availability.

CANCELLATION POLICY

Cancellation must be via email to dive@prodive.co.za and cancellations must be made 24 hours prior the excursion
Group booking cancellations must be done no later than 7 days prior the excursion
Should Pro Dive cancel an excursion due to unforeseen weather conditions, legitimate circumstance or lack of passengers on boat charters, Pro Dive retains the right to offer the customer an alternative date and time or make make a full refund to the customer. This will only apply if Pro Dive contacts thecustomer to advise the activity has been cancelled.
Should there be any discrepancies with regards to payments, or should a refund be in order, this must be transacted and finalised within 30 days of the activity date. Should this not be finalised within the 30 days of activity date Pro Dive has the right to do a refund as a Gift Voucher

REFUNDS

Where an activity was cancelled by the customer 24 hour prior the excursion a 100% refund will given
via EFT to a South African bank account, or via the means the original payment was made for
international customer.
Where a activity was cancelled after the 24 hour period prior the excursion a customer will only be refunded 50% of the excursion cost therefore the customer will forfeit 50%

NO SHOW

In the event of a customer not cancelling their activity with Pro Dive and they do not report for the activity or partake no refund will be given.
In the event of unfavourable weather conditions clients must still report to Pro Dive unless Pro Dive has notified them that the activity has been cancelled. Should the customer not report to Pro Dive for the activity no refund will be given, nor will an alternative date be arranged. No shows will be charged in full. No refunds, alternative activity date of gift voucher will be given.

IN THE EVENT OF BAD WEATHER

Safety is a priority and Pro Dive has the right to cancel, postpone or change the activity for the safety of customers and staff in the event of unfavourable weather conditions.
Pro Dive will not be held liable for any additional costs incurred for the postponement of Scuba Diving. This includes but is not limited to; travel expenses, accommodation.

RISK

ALL watersport activates entails known and unanticipated risks, which could result in physical or emotional injury, paralysis, death or damage to a person, to property, or to third parties. I understand that such risk simply cannot be eliminated without jeopardising the essential quantities of activity. The risks include amongst other things: boat capsize, adverse, conditions and currents; prolonged exposure to cold water, hypothermia, accidental drowning, mental anguish or trauma, exposure to sun, strong wind, cold, storms, large waves, eddies and whirlpools, and lightening: aggressive and/or poisonous wildlife;
wrists, arm, shoulder or back injuries’ slips and falls while walking; and rapidly changing adverse weather and water conditions’ and damage or loss of property. Furthermore, Pro Dive guides have difficult jobs to perform. They are very safety conscience, but they are not infallible. They might be ignorant of a participant’s wellness or abilities. They might misjudge the weather, the elements, or terrain. They may be inadequate warnings or instructions, and the equipment being used might malfunction. I expressly agree and promise to accept and assume all of the risk existing in these water sport activities.
My participation in these activities are purely voluntary, and I elect to participate in spite of the risks.

INDEMNITY

All passengers are required to sign an indemnity form for all activities they are participating in prior to the start or departure of the activity. In case guest refuse to sign the indemnity form the guest will not be able to partake in the activity and
will not receive any refund.
The indemnity form must signed by a Parent/Legal guardian for children under 18 years.
Any unaccompanied child under 18 requires the indemnity to be signed by a parent/legal guardian prior
to the activity.

MINIMUM CAPACITY

This service has a minimum capacity of 6 customers in order for the trip to proceed. If minimum capacity has not been reached at the time of the trip, then the trip will be cancelled.

GENERAL

Pro Dive reserves the right to amend/cancel/add terms & conditions without notice.

Customer privacy policy
Pro Dive - Port Elizabeth shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

Payment options accepted
Payment may be made via Visa, MasterCard, credit cards for online bookings. Bank transfers or cash will only be accepted for direct bookings into the Pro Dive - Port Elizabeth bank account, the details of which will be provided on request
Credit card acquiring and security
Credit card transactions will be acquired for Pro Dive - Port Elizabeth via PayGate (Pty) Ltd who are the approved payment gateway. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no credit card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
Customer details separate from card details
Customer details will be stored by Pro Dive - Port Elizabeth separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za
Merchant Outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).
Responsibility
Pro Dive - Port Elizabeth takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods
Country of domicile
This website is governed by the laws of South Africa and Pro Dive - Port Elizabeth chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other
documents or communication of whatsoever nature.
Variation
Pro Dive - Port Elizabeth may, in its sole discretion, change this agreement or any part thereof at any time without notice.
